These terms cover your use of the Sovara Pay website. Merchant services are governed by a separate merchant processing agreement.
Agreement to these terms
These Terms of Use ("Terms") govern your use of sovarapay.com, sovarapay.app and related pages (the "Site"), operated by Sovara Payment Solutions, LLC ("Sovara," "we," "us"). By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
About us
Sovara Pay is a service of Sovara Payment Solutions, LLC, a sub-ISO of First Nationwide Payments, a registered ISO of Wells Fargo Bank, N.A., Concord, CA. Sovara is not a bank. Merchant accounts are provided through our processing partners and sponsor bank.
Merchant services are separate
The Site provides general information about our services. It is not an offer to provide merchant services. All merchant accounts are subject to application, underwriting and approval by our processing partners and sponsor bank, and are governed by a separate merchant processing agreement. If that agreement conflicts with these Terms, the merchant processing agreement controls for your merchant account.
Quotes and pricing
Examples on the Site, including the sample receipt, illustrate how pricing works and are not a quote. Card network costs such as interchange and assessments are set by card-issuing banks and card networks and may change. Your rates and fees are only those stated in writing in your quote and merchant processing agreement.
Using the Site
You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms;
- submit false information or information about another person without their permission;
- try to gain unauthorized access to the Site or its systems, or interfere with how it works;
- scrape, copy or reuse the Site's content except as allowed below;
- send card numbers, bank account numbers or other sensitive financial data through the quote form.
Our content and trademarks
The Site and its content, including text, graphics, logos and design, belong to Sovara or its licensors and are protected by intellectual property laws. You may view and print pages for your own business use. Sovara, Sovara Pay and the Sovara Pay logo are trademarks of Sovara Payment Solutions, LLC. Card brand and digital wallet names are trademarks of their respective owners and are used only to identify the payment methods we support.
Third-party links
The Site may link to websites and services we don't control. We aren't responsible for their content, policies or practices.
Privacy
Our Privacy Policy explains how we collect and use information through the Site.
Disclaimers
The Site is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free or free of harmful components, or that its information is complete or current.
Limitation of liability
To the fullest extent allowed by law, Sovara and its members, managers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site. Our total liability for any claim related to the Site is limited to one hundred dollars ($100). Some jurisdictions don't allow these limits, so they may not apply to you.
Indemnity
You agree to defend and indemnify Sovara against claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute related to the Site will be brought in the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. We'll post the new version on this page and change the effective date above. Your continued use of the Site after a change means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Sovara about the Site.
